Sponsor

Nuclear Blast GmbH (Registergericht: Amtsgericht Ulm, registration number: HRB 540822) hereafter (« the Sponsor ») organizes a free Sweepstakes, with NO PURCHASE NECESSARY TO ENTER OR WIN, from {startDate} to {endDate} at midnight, accessible online only (the “Sweepstakes”).

Eligibility

The Sweepstakes are open to any natural person resident from {territory} and aged {minimumAge} years or over at the time of their participation (the “Participants”), except employees of the Sponsor and its affiliated companies, or of its suppliers, service providers, agents or any third party directly associated with the administration of the Sweepstakes, as well as their family and household members.
Each Participant can only participate once (same name and/or address and/or phone number and/or email address).

How to enter

To enter the Sweepstakes, the Participant shall:

Save a piece of content from {artistName} in the music streaming service of his/her choice (Spotify, Apple Music, etc…),
Fill in and validate the online participation form.

The Participant is responsible for all service costs associated with entering the Sweepstakes (if any), such as internet connection costs. The Participant will not be able to request reimbursement of such costs from the Sponsor.

Selection of winner(s)

{winnersCount} winner(s) will be designated by random drawing realized electronically within 15 days following the end of the Sweepstakes.

The Winner(s) will be informed by email or text message within 7 days following the draw (the “Notification”) and must provide in answer his/her name and a postal address where the prize will be sent, if this prize cannot be sent by email. Other Participants will not be contacted by the Sponsor.

Prizes

The randomly selected winners will win the following prizes:

These prizes will not be substituted (included for cash) or exchanged.
The prizes delivery will be assumed by the Sponsor, at his costs. Any prize which cannot be delivered, or is sent back to the Sponsor, for reasons not attributable to the Sponsor (wrong address, no answer from the Participant, etc.) can be claimed by the Participant to whom it was attributed for 1 month following a notice of failed delivery or return. After this time, the prize will be permanently lost.

Liability

The Sponsor shall not be held responsible for Force Majeure events, or any event beyond the Sponsor’s reasonable control, affecting the Sweepstakes. In such a case, the Sponsor can, at its sole discretion, cancel, modify, shorten or prolongate the Sweepstakes, or replace the advertised prize with another prize of similar value.

The Sponsor is not responsible for any delay or failure to receive Notification for any reason, including inactive account(s), technical difficulties associated therewith, or Winner’s failure to adequately monitor the email account.

Liability for any applicable taxes and any other expenses not specifically provided for by the Sponsor in these Rules are the sole responsibility of the Winner.

By entering the Sweepstakes, you agree to be bound by these Rules and to release and hold the Sponsor, all its affiliates, subsidiaries, advertising and promotions agencies, and each of their respective agents, representatives, officers, directors, shareholders, employees and assigns, harmless from any and all liability arising out of your participation in this Sweepstakes including, without limitation, with respect to the awarding, receipt, use and/or misuse of any prize or cancellation of the Sweepstakes. Winner participates in the use of the prize with knowledge of the risks involved and agrees to accept them.

Personal Information

Personal Information (identity and contact details) provided by the Participant upon his/her entering the Sweepstakes or by the Winner following the Notification, will be processed by the Sponsor based on the consent of the Participants.

Personal Information will be stored in an electronic file and are necessary for the processing of the Sweepstakes’ participation, determination of the Winners, and delivery of the prizes.

Personal Information will be accessible only to the Sponsor’s marketing teams and to the Sponsor’s service providers involved with the Sweepstakes operation (if any).

In addition to its participation in the Sweepstakes, the Participant can also choose to receive, from time to time, information about the artist through emails from the Sponsor. This subscription is optional, and the Participant can unsubscribe at any time by clicking on “unsubscribe” in the email received.

The Participant can access his/her Personal Information stored by the Sponsor, correct it or request it to be erased, or ask for the Sponsor to send him/her a copy of said information. To exercise these rights or for any questions regarding the processing of his/her Personal Information, the Participant can contact the Sponsor by filling the following form.

Miscelaneous

Participation to the Sweepstakes implies unconditional acceptance of these Sweepstakes rules. Any Participant in breach of these rules or trying to increase his/her chances to win by fraud, in any way whatsoever, can be excluded from the Sweepstakes.

These Sweepstakes rules are subject to German law. Any disputes arising from the participation in the Sweepstake and/or these Sweepstake rules shall be heard by the jurisdictions of the Nuclear Blast’s GmbH registered office.
